Terms & Conditions (Effective May 12, 2025)

Applies To: All clients, users, & visitors within the United States who access or engage with Empowered Harmony Counseling, Psychiatry & Wellness Center.

By using this website, scheduling appointments, or engaging in telehealth services, you acknowledge that you have read, understood, & agree to these Terms & Conditions. If you disagree, you must not use the Platform or receive services.

 

1. About Empowered Harmony & the Platform

Empowered Harmony Counseling, Psychiatry & Wellness Center is a U.S.–based C-Corporation registered in Wyoming providing nationwide therapy, psychiatry, coaching, consulting, & wellness services.


We contract with independent licensed providers who are credentialed to practice in their respective states. All providers are independent contractors, not employees.

 

2. Scope of Services

We offer therapy, psychiatry, coaching, consulting, wellness programs, evaluations, VIP support, & specialized documentation.
Services may vary by state based on licensure. Coaching & consulting are educational & non-clinical and not a substitute for medical or therapeutic care.

 

3. Telehealth Licensure & Eligibility

Telehealth services are provided only where providers hold an active license. Clients must be physically present in that jurisdiction during sessions.


Clients must be 18 years or older or have a guardian’s consent. Services are not offered outside the United States.

 

4. Telehealth Informed Consent

By participating in telehealth, you acknowledge the benefits & limitations of virtual care, including occasional technical issues or privacy risks.


Sessions are conducted through encrypted, HIPAA-compliant systems. Empowered Harmony does not record sessions without written consent. You may request additional informed consent materials at any time.

 

5. Provider Qualifications

Licensed providers include but are not limited to:

  • Licensed Clinical Social Workers (LCSW, LICSW, LLMSW)

  • Licensed Professional Counselors (LPC)

  • Psychiatrists (MD, DO)

  • Psychiatric Nurse Practitioners (NP)

  • Licensed Marriage & Family Therapists (LMFT)

 

Wellness professionals are vetted for training, certification, & experience. All licenses are verified before contracting.

 

6. Privacy & HIPAA Compliance

All protected health information is secured under HIPAA & state law. Our Privacy Policy details data collection & security measures.
Clients may request a copy of the Notice of Privacy Practices at any time. See www.empoweredharmony.com for details.

 

For billing, privacy, or policy concerns, contact support@empoweredharmony.com within seven (7) days of the issue.

 

7. Accessibility & Non-Discrimination

Empowered Harmony complies with ADA & WCAG 2.1 AA standards. We do not discriminate based on race, color, religion, gender, identity, orientation, age, disability, national origin, or military status.

8. Cookies & Analytics

Our site uses cookies & analytics tools to improve performance & user experience. You can disable cookies in your browser settings at any time.

 

9. Account Responsibilities

You agree to:

  • Provide accurate personal information

  • Maintain confidential login credentials

  • Notify us of unauthorized use

  • Use services only for personal care

  • Cancel sessions at least 24 hours before to avoid fees

Violation may result in suspension or termination.

 

10. Fees, Billing, & Payment

Empowered Harmony uses a fee-for-service model. Payment is required at booking unless otherwise arranged.

Policies:

  • Late cancellation (<24 hours): $100

  • Psychiatry no-show: up to $150

  • Specialty services: Full price

  • Fees are non-refundable after services occur.

  • Credits do not roll over without a written agreement from the CCWO.

Accepted methods: major cards, HSA/FSA, Klarna, Stripe, or approved processors.

 

11. Insurance Authorization & Responsibility

Insurance benefits are verified for eligibility but not guaranteed. Clients remain responsible for copays, deductibles, & uncovered balances. Denied claims are the client’s obligation.

 

12. Refunds, Credits, & Promotions

Refunds apply only to billing errors or unrendered services caused by provider or system failure. Requests must be submitted within seven (7) days.


Credits expire within the billing cycle. Promotions are time-limited & non-transferable. Subscription, wellness, coaching packages, and other services follow the same rules.

 

13. Documentation & Administrative Services

A $150 fee applies per request (up to six pages). Includes letters, forms, disability paperwork, FMLA, summaries, or agency documents.


Edits or revisions require a new fee. All reports remain the property of the provider and require written consent for release. ESA letters require three sessions.

 

14. Record Retention

Records are kept for a minimum of seven (7) years after the last session or longer if required by law, then securely destroyed.

 

15. Waitlist & Provider Availability

Availability depends on state, specialty, & insurance. If no provider is available, you may be placed on a waitlist at no cost until matched.

 

16. Provider Independence & Discretion

Providers make all clinical decisions. Empowered Harmony is not liable for clinical outcomes. Providers may decline or terminate care for:

  • Clinical inappropriateness

  • Conflicts of interest

  • Harassment or safety concerns

  • False or incomplete disclosures
    Alternative referrals may be offered.

 

17. Confidentiality & Legal Limits

Information is confidential except when the law requires disclosure (risk of harm, abuse, court orders). Providers follow federal & state reporting laws.

 

18. Technology Risks & Disruptions

Telehealth may experience technical failures. Empowered Harmony is not liable for internet, device, or software issues. Clients should maintain a stable connection & private setting.

 

19. Emergency & Crisis Services

Empowered Harmony does not provide emergency or inpatient care. If you are in danger, call 911 or 988 or visit the nearest emergency department.

 

20. Scheduling & Cancellation

All intake forms must be completed 72 hours before the first appointment. Payment processes 24 hours before.
Driving during a session is prohibited & counted as a late cancellation. Full payment is required to hold recurring appointments.

 

21. Chargeback Policy

No refunds or chargebacks except for duplicate payments or administrative errors. All billing disputes must be handled directly with EHC.

 

22. Informed Consent for Treatment

By using services, you consent to:

  • Participate in therapy, psychiatry, or coaching via telehealth

  • Allow secure documentation & progress tracking

  • Receive HIPAA & privacy disclosures
    Consent may be withdrawn in writing at any time, but services may end if withdrawn.

 

23. Client Conduct & Termination

Services may be ended for unlawful use, abuse, or boundary violations. Repeated no-shows may lead to discharge. Clients may terminate care at any time by notice to their provider or the admin team. Prior charges remain due.

 

24. Veteran, Military Family Support & Allyship

We honor active-duty service members, veterans, & their families. Providers are trained in trauma-informed, military-competent care.


We proudly serve LGBTQIA+ communities, people of color, Indigenous populations, & individuals with disabilities. We are an ally organization committed to equity & healing.

 

25. Tricare & VA Community Care Network (CCN)

a. Tricare Clients – Services are provided only by fully licensed clinicians. Pre-authorization is required. Tricare does not cover no-shows; clients remain responsible.
b. VA CCN Clients – Valid TriWest or OptumServe authorization is required. Out-of-scope or missed sessions may be client-billed.

26. Marketing Communications & Disclaimer

By providing your contact information, you agree to receive limited updates, appointment reminders, or wellness communications. You may opt out at any time.


Phrases such as “elite-level care,” “VIP experience,” or “transformative healing” describe our mission & do not guarantee results. Outcomes vary by individual.

 

27. Arbitration & Dispute Resolution

All disputes, claims, or controversies arising out of or relating to this Agreement will be resolved through binding arbitration in Cheyenne, Wyoming, under American Arbitration Association (AAA) rules.


Clients may opt out of arbitration within 30 days of entering care by written notice.
Regulatory complaints & small-claims cases are exempt.


By agreeing to these Terms, you waive your right to participate in class actions or jury trials.

 

28. Force Majeure & Limitation of Liability

Empowered Harmony is not liable for delays or failures caused by natural disasters, pandemics, internet or power outages, or events beyond our control.


We are not responsible for damages from misuse of services, telehealth interruptions, or third-party payment errors.

 

29. Governing Law & Jurisdiction

This Agreement is governed by the laws of Wyoming or the current state of residence of the Chief Clinical & Wellness Officer (CCWO).


Any legal action not subject to arbitration will be filed in the state or federal courts of Cheyenne, Wyoming or the CCWO’s residence state.

 

30. Entire Agreement

These Terms & the Privacy Policy constitute the entire agreement between you & Empowered Harmony.
Verbal statements or informal promises do not override these written terms.

 

31. Provider Employment Status

All providers are independent contractors. Empowered Harmony does not supervise or direct their clinical judgment. Providers are responsible for maintaining active licenses & ethical compliance.

 

32. Accessibility Statement

Empowered Harmony strives to maintain a fully accessible website & digital environment that meets or exceeds WCAG 2.1 AA standards.
Accessibility feedback can be submitted to support@empoweredharmony.com.

 

33. Cookies & Data Analytics

Our website uses cookies & analytics tools to measure traffic & improve functionality.
Users can adjust browser settings to disable cookies.
We do not sell or share identifying information for advertising purposes.

 

34. Financial Responsibility & Acknowledgment

Clients agree to be financially responsible for all services not covered by insurance.
Insurance information must remain current.
A Financial Consent Form must be signed before the start of care.

 

35. Insurance Authorization, Verification, & Disclaimers

Empowered Harmony verifies insurance eligibility but cannot guarantee payment.
Clients must understand their benefits, copays, & exclusions.
You authorize Empowered Harmony to contact your insurer to coordinate care & reimbursement.

 

36. Documentation Ownership

All documentation, letters, or reports are the property of the provider until released with written authorization.
Additional revisions beyond the initial scope incur extra fees.
Records are shared only with valid written consent or legal requirement.

 

37. Technology & Informed Consent

Telehealth services use encrypted platforms, but data transmission carries inherent risks.
You understand Empowered Harmony does not record sessions & may experience technical disruptions.
You may request extra information about risks & alternatives.

 

38. Patient Conduct & Termination of Care

Providers may terminate services if a client engages in harassment, threats, discrimination, or consistent no-shows.
Alternative referrals may be offered when appropriate.


Empowered Harmony reserves the right to remove access to the Platform to maintain a safe care environment.

 

39. Cancellation & No-Show Policy

a. Therapy, Coaching, & Wellness Services: $100 per missed or late-canceled session.
b. Psychiatry Appointments: Up to $150 per missed session.

 

Repeated missed sessions may result in termination of care. These fees are not billable to insurance or Tricare.

 

40. Subscription, Packages, & Coaching Programs

Some services may be offered as subscription or bundled programs.

Subscriptions automatically renew unless canceled before the next billing cycle.

Unused sessions expire at the end of each cycle unless otherwise stated.
Refunds are unavailable once services begin, except in cases of billing errors.

 

41. Refunds, Credits, Complaints & Specialty Services

Refunds are only issued for billing errors or unrendered services due to provider or system failure.
Requests must be made in writing within seven (7) days of the incident.
Free trials or discounts may end at any time. After a promotion ends, standard billing resumes.

Any billing or service concern must be reported directly to your provider or to Empowered Harmony Counseling, Psychiatry & Wellness Center within seven (7) days of the date of service.
Requests received after seven (7) days will not be reviewed or refunded.

 

Specialty Services:
Refunds or credits for specialized services, such as assessments, evaluations, documentation, mediation, or subscription programs, are considered only when the cancellation is received with at least seventy-two (72) hours’ notice before the scheduled appointment, and the written request is received within seven (7) days of the cancellation.

 

Late or incomplete requests will not qualify for a refund or credit.

All CCWO-approved refunds are processed within thirty (30) business days by the original payment method.
Chargebacks are not permitted; all disputes must be resolved directly with Empowered Harmony counseling.

 

42. Record Requests & Administrative Time

Processing of clinical records, summaries, or letters may take up to fourteen (14) business days.
Expedited requests may incur an additional administrative fee.
Records are released only with written consent.

 

43. Crisis & Medication Policies

Empowered Harmony Counseling does not provide crisis management or emergency services.
Psychiatric medication management requires scheduled visits & compliance with provider treatment plans.
Refills are not given without active engagement in care at EHC.

 

44. Legal, Financial, & Medical Advice Disclaimer

No provider may offer legal or financial advice outside their license and scope of practice.
Recommendations are clinical opinions only & not guarantees of results.
You are encouraged to consult licensed professionals in other fields for those needs.

 

45. Notice of Privacy Practices

Empowered Harmony complies with HIPAA & state privacy laws.
Clients can request a complete Notice of Privacy Practices that describes how information is used & disclosed.
You may contact support@empoweredharmony.com for a copy.

 

46. Non-Clinical Coaching Disclaimer

Coaching, consulting, & educational programs are not psychotherapy or medical treatment.
They are designed for personal development, lifestyle change, & wellness education.
Participation is voluntary & may not be covered by insurance.

 

47. Data Retention & Secure Destruction

Client records are stored securely for at least seven (7) years after the last service date.
After that, files may be permanently destroyed under HIPAA-compliant procedures.

 

48. Marketing Language & Representation

Statements like “gold standard in wellness,” “elite care,” or “transformative healing” are motivational, not clinical guarantees.
Such phrasing expresses our vision for compassionate, high-quality service, not a promise of outcome.

 

49. Updates & Modifications to Terms

Empowered Harmony reserves the right to modify these Terms at any time.
Updated versions will be posted with a new effective date. Continued use of services means acceptance of revisions.

All names listed represent the same legal entity and may be used interchangeably throughout this document and across company materials, policies, forms, or digital platforms.

52. Communication & Availability Disclosure

Empowered Harmony Counseling, Psychiatry & Wellness Center, including all affiliated emails, phone numbers, & digital contact methods, is not monitored 24 hours a day, 7 days a week, 365 days a year.


Messages received outside of regular business hours, on weekends, or on holidays will be reviewed during the next available business day.


Our communication channels are not for crisis or emergency situations. If you are in immediate danger or experiencing a medical or mental health emergency, call 911 or 988 or go to the nearest emergency department.

Providers may offer sessions seven days a week between

7:00 AM and 9:00 PM. Availability depends on each provider’s schedule.​​​​​​
