​​​​Applies To: All clients, users, and visitors in the United States who access or engage with Empowered Harmony Counseling, Psychiatry & Wellness Center.

These Terms and Conditions (the “Agreement”) govern your access to and use of the digital services, telehealth platform, mobile applications, and online tools (collectively, the “Platform”) operated by Empowered Harmony Counseling, Psychiatry & Wellness Center (“Empowered Harmony,” “we,” “us,” or “our”).

By accessing or using the Platform, scheduling services, or entering into care with our providers, you agree to be bound by this Agreement and all applicable laws and regulations. If you disagree with these terms, you must not use or receive services through the Platform.

1. About Empowered Harmony and the Platform
Empowered Harmony Counseling, Psychiatry & Wellness Center is a U.S.-based virtual mental health and wellness organization offering nationwide therapy, psychiatry, coaching, consultation, and support services. Services are provided through secure telehealth and technology-based platforms accessible online. The company is incorporated in Wyoming and serves clients exclusively within the United States.

We contract with independent licensed therapists, psychiatric providers, wellness practitioners, and life coaches (“Providers”) who deliver care through our Platform. These Providers are not employees of Empowered Harmony but independent contractors fully credentialed to practice in their respective states.
2. Use of the Platform and Provider Services
a. Eligibility and Jurisdiction
To use this Platform, you must be 18 years or older or have valid parental or guardian consent. You must also be physically located in a U.S. state or territory where the provider is licensed to practice. We do not currently offer services outside the U.S.

b. Provider Qualifications
All licensed providers offering therapy or psychiatry services are independently credentialed and licensed in the United States or supervised by an independently licensed provider. Providers may include:

Licensed Clinical Social Workers (LCSWs, LICSWs, LLMSWs)

Licensed Professional Counselors (LPCs)

Psychiatrists (MDs, DOs)
-
Psychiatric Nurse Practitioners (NPs)
-
Licensed Marriage and Family Therapists (LMFTs)

Wellness coaches or holistic providers are typically credentialed based on their experience, certifications, or professional training relevant to their respective disciplines. Empowered Harmony verifies all licenses before contracting but does not supervise or direct providers’ clinical work.

c. Limitations of Virtual Services
The Platform is not appropriate for crises or emergency care. If you are in immediate danger or experiencing a medical or mental health emergency, call 911 or go to the nearest emergency room.

Empowered Harmony does not provide in-person services. We are no substitute for emergency, hospital, or inpatient psychiatric care. The Platform is not intended to be used for court-mandated therapy, evaluations requiring in-person testing, or disability or emotional support animal certifications unless explicitly stated by your provider.

3. Privacy and Security
All interactions on the Platform are governed by our HIPAA-compliant Privacy Policy, which is incorporated by reference into this Agreement. Your personal and health information is safeguarded through industry-standard encryption, secure telehealth systems, and role-based access.

4. Your Responsibilities and Account Access
You agree to:

Provide accurate and truthful information when signing up

Keep your login and account information confidential

Notify us immediately of any unauthorized access or use of your account

Use services solely for personal therapeutic or wellness use (not for resale or third parties)

Cancel sessions at least 24 hours in advance to avoid no-show fees
Any violation of these terms may result in suspension or termination of access to the Platform.
5. Session Fees, Subscription, and Payment
Empowered Harmony operates on a fee-for-service model. Payment may be made via self-pay or through participating insurance plans. Subscription or coaching packages may be offered for certain non-clinical services.
a. Billing Policies:

Clients are charged per session or per package unless otherwise noted
-
Sessions canceled with less than 24 hours’ notice may result in a $100 late cancellation fee
-
Fees are non-refundable once services are rendered
-
Unused session credits do not roll over unless stated in writing
b. Insurance Clients:
We accept certain insurance plans and verify benefits at the time of intake. Clients are responsible for copays, deductibles, and non-covered services. Empowered Harmony is not liable for inaccuracies in insurance quotes provided.
6. Refunds, Credits, and Free Trials
a. Refunds:
Refunds for unused sessions are only granted if a billing error occurred or services were not provided due to a documented provider or system issue. Requests must be submitted in writing within seven (7) days of the incident. Refunds are not available for completed services.
b. Credits:
Session credits must be used within the billing cycle in which they were purchased or granted. Expired credits do not roll over.
c. Promotions:
From time to time, Empowered Harmony may offer discounts or promotional packages. All such offers are time-limited, non-transferable, and may be revoked if terms are violated. Once it ends, standard billing begins unless canceled.
7. Disclaimers and Limitations
a. No Medical Emergency Services
Empowered Harmony does not provide emergency medical care. If you are in danger or need immediate help, call 911 or go to the
nearest hospital. The Platform and Providers cannot respond to emergency messages or act as crisis response teams.
b. No Guarantees of Outcome
While we strive to offer high-quality care, we do not guarantee clinical results, outcomes, or resolution of mental health issues. Outcomes vary depending on individual circumstances, level of engagement, and the chosen treatment approach.
c. Use at Your Own Risk
You acknowledge that use of our services is voluntary and may involve emotional discomfort. You agree to release Empowered Harmony and its affiliates from liability for outcomes resulting from voluntary participation.
d. Legal and Financial Advice Disclaimer
No provider may offer legal, financial, or medical advice outside the scope of their license. Recommendations related to medications, diagnoses, or treatment plans are made solely at the provider’s discretion and clinical judgment.

8. Intellectual Property and Platform Use
All content on the Platform, including branding, logos, written materials, assessments, images, software, tools, and videos, is the intellectual property of Empowered Harmony Counseling, Psychiatry & Wellness Center. Unauthorized reproduction, distribution, or commercial use is prohibited.
You are granted a limited, non-exclusive, non-transferable license to use the Platform solely for personal therapeutic and wellness services.
9. Termination and Suspension of Access
We reserve the right to suspend or terminate your access to the Platform or services at any time for violations of this Agreement, non-payment, fraud, or misuse of services. Clients who engage in abusive, harassing, or threatening behavior will be permanently banned from the Platform.

10. Arbitration Agreement
All disputes, claims, or controversies arising out of or relating to your use of the Platform or services shall be resolved exclusively by binding arbitration in Cheyenne, Wyoming. You waive your right to participate in class actions and jury trials.
Exceptions include:

Filing complaints with the government or regulatory agencies

Small claims court cases
-
Legal emergencies or criminal offenses
Arbitration shall follow the rules of the American Arbitration Association (AAA).
11. Indemnification
You agree to indemnify, defend, and hold harmless Empowered Harmony, its directors, officers, contractors, affiliates, and providers from any claims, damages, or losses resulting from:

Misuse of the Platform

Violation of this Agreement

Service-related disputes

Breach of any representations made by you
12. Platform Availability and Technical Issues
We strive to maintain reliable access; however, technical issues, outages, or maintenance may occasionally cause interruptions. Empowered Harmony is not liable for system failures, internet problems, or external service provider disruptions.
13. Export Control and Sanctions Compliance
You represent that you are not subject to U.S. government sanctions or located in an embargoed country. You agree to comply with all applicable U.S. export and technology transfer laws.

15. Governing Law and Venue
The laws of the State of Wyoming or the current residence of the CCWO shall govern this Agreement. Any legal action not subject to arbitration shall be brought in the state or federal courts of Cheyenne, Wyoming, or the CCWO’s state of residence.
16. Modifications to Terms
We reserve the right to change or update this Agreement at any time. The most recent version will always be posted online, accompanied by the updated effective date. Continued use of the Platform after modifications constitutes your agreement to the new terms.
17. Severability
If any term of this Agreement is held unenforceable, the remaining provisions will remain valid and in full force.
18. California and Regulated State Disclosures
If you reside in a regulated state such as California, you may file complaints with the appropriate licensing board.

19. Provider Independence and Scope
All clinical decisions, diagnoses, and treatment plans are the sole responsibility of the provider. Empowered Harmony is not responsible for the clinical content of any sessions. Providers are required to operate within their state’s legal scope of practice.
20. Eligibility to Use Platform
You confirm that you:

Are at least 18 years old or have a guardian's consent

Are located in a U.S. jurisdiction where services are offered

Are legally able to consent to mental health care

Will not use services for unlawful, harmful, or exploitative purposes
False representation of your identity or eligibility may result in account termination.
21. Service Availability and Waitlist Policy
Provider availability may vary depending on location, specialty, and insurance coverage. You may be added to a waitlist if no suitable provider is immediately available. You will not be billed until matched.
22. Provider Discretion to Decline or Discharge Clients
Providers may terminate care or decline service based on:

Clinical fit or appropriateness

Conflicts of interest

Harassment or safety concerns

False or incomplete disclosures
Alternative referrals may be offered where appropriate.
23. Technology and Informed Consent
You understand and agree that:

Telehealth involves encrypted communication, but has inherent risks

Empowered Harmony Counseling does not record sessions

You may request additional informed consent materials
-
Technical difficulties may occasionally disrupt session quality
24. Communications and Secure Messaging
All official communications should occur through the secure client portal. Sensitive information should not be shared via unencrypted email or text unless you provide explicit written consent.
25. Informed Consent for Treatment
By using our services, you consent to:

Participate in therapy, psychiatry, or coaching via telehealth

Allow your provider to document and track progress

Follow treatment recommendations

Receive HIPAA and privacy rights disclosures
26. Accessibility and Non-Discrimination
Empowered Harmony does not discriminate based on race, gender, religion, age, disability, sexual orientation, national origin, military status, or other protected categories. We comply with ADA and accessibility requirements. Accommodation requests may be sent to: support@empoweredharmony.com
27. Client-Initiated Termination of Services
Clients may cancel services at any time by notifying their provider or the Empowered Harmony admin team. You will not be charged after the cancellation date. Prior charges are non-refundable unless a billing error occurred.
28. Force Majeure
Empowered Harmony Counseling is not liable for service delays or failures due to causes beyond our control, including pandemics, natural disasters, power outages, or civil unrest.
29. Entire Agreement and Waiver
This Agreement, together with the Privacy Policy, represents the entire agreement between you and Empowered Harmony. Verbal promises or informal statements do not override these terms. Waivers must be made in writing.
30. Veteran, Military Family Support & Allyship Commitment
Empowered Harmony honors the service of:

We offer trauma-informed, culturally competent care with providers trained in military culture and mental health.
We proudly serve and affirm LGBTQIA+ communities, people of color, disabled individuals, Indigenous populations, and other underserved groups. Empowered Harmony is an ally organization committed to equity, social justice, and healing-centered engagement.

31. Insurance Participation: Tricare and VA Benefits
Empowered Harmony is working toward and supports participation in Tricare and the VA Community Care Network (CCN).
a. Tricare Clients

Services provided only by fully licensed clinicians

Clients must obtain required pre-authorizations

Tricare does not cover no-shows; clients will be responsible if they agree to these terms
b. VA CCN Clients

Must provide valid authorization via TriWest or OptumServe
-
Out-of-scope services or missed sessions may be billed directly to the client
32. Financial Responsibility and Acknowledgment
All clients agree to:

Be financially responsible for all services not covered by insurance

Keep insurance info up to date
-
Sign a Financial Consent Form before services begin
33. Insurance Authorization, Verification, and Disclaimers

We verify eligibility, but cannot guarantee payment

Clients must understand their coverage, co-pays, and exclusions
-
Denied claims are the client’s responsibility
-
You authorize us to contact your insurer to coordinate care and reimbursement
34. No-Show and Late Cancellation Policy
a. Therapy, Coaching, and Wellness Services:

$100 fee for missed or late-canceled sessions
b. Psychiatry Appointments:
-
Up to $150 fee for no-shows
-
Repeated no-shows may lead to discharge
These fees are not billable to Tricare, VA, or insurance and are your responsibility.
35. Consent to Contact, Records Use, and HIPAA Authorization
You consent to:

Be contacted for scheduling and billing
-
Allow treatment notes to be documented securely
-
Allow us to share limited info with insurers for coverage or reimbursement
You may revoke consent at any time in writing, which may impact service eligibility.
36. Branding and Marketing Language Disclaimer
As part of our marketing, Empowered Harmony Counseling may use aspirational language such as:

“Elite-level care”
-
“Gold standard in wellness”
-
“VIP experience”
-
“Transformative healing”
These are reflections of our mission and commitment—not legally binding guarantees. Outcomes depend on individual factors.
37. Business Overview
Empowered Harmony is a registered C-Corporation in Wyoming, offering psychotherapy, psychiatry, coaching, consulting, and wellness services nationwide. Services may be delivered via telehealth, in-person (where applicable), or online platforms.
38. Booking and Service Delivery

Appointments are required

Clients must provide accurate personal and health info

Empowered Harmony may reschedule or refuse services for legal, safety, or ethical reasons
39. Payments and Billing

Payment is due at booking unless otherwise arranged

We accept all major credit/debit cards, HSA/FSA, Klarna, and Stripe (subject to their terms)

We are not liable for third-party fees, denials, or late charges related to Buy Now, Pay Later services
40. Cancellation and Refund Policy

Coaching, courses, and consulting sales are final unless otherwise stated

Refunds only provided for duplicate payments or administrative errors
41. User Responsibilities
You agree to:

Ensure a stable internet connection
42. Confidentiality and Privacy
We comply with HIPAA and applicable privacy laws. All client data is stored and transmitted securely. See our Privacy Policy for details.
43. Intellectual Property
All content created by Empowered Harmony is our intellectual property. You may not reuse or sell any content without written permission.
44. Dispute Resolution
We encourage clients to reach out directly to resolve concerns. If unresolved, disputes will be handled per Wyoming law or through arbitration.
45. Limitation of Liability
Empowered Harmony Counseling is not liable for damages caused by:

Client misuse of services

Miscommunication of health conditions

Technical issues during telehealth

Third-party processing errors
46. Acceptance of Terms
By using our website, scheduling services, or communicating with EHC, you agree to abide by these Terms and Conditions in full.
