If a non-waivable law in the client's state of location requires a different rule for a specific issue, that Law governs the issue.

Empowered Harmony Counseling, Psychiatry & Wellness Center may update these Terms of Use at any time. Continued use of the website constitutes acceptance of the revised terms.

These Terms apply to the use of our website, contact forms, intake forms, patient portal, messaging, scheduling, and payments, including payments submitted through third-party platforms.

PHI means protected health information.
Portal means EHC's secure EHR or patient portal used for clinical communication, scheduling, documents, and billing.
Provider means an independently licensed or credentialed clinician, psychiatric provider, coach, intern under supervision, or wellness professional offering services through EHC.
Client and patient mean a person receiving services from EHC. These terms may be used interchangeably.
Coaching means educational and wellness-focused services that are not psychotherapy or medical treatment.
Telehealth means services delivered via video or phone using HIPAA-compliant platforms when required.
Specialized services mean concierge services, sliding-scale tiers, programs, prepaid plans, group services, documentation services, or any other tier with separate rules.
A deposit means a partial payment used to reserve a future appointment or service.
No show means missing an appointment, arriving too late to complete the session, or failing to attend after payment and scheduling.
Late cancellation means canceling outside the required notice window for the service type.

19. Communication and Privacy Protection
Providers may use email, Google Voice, or other HIPAA communication tools for administrative or scheduling matters.
All private health information is shared only through our secure EHR portal to protect your privacy.
All confidential communication must occur through EHC's secure patient portal.
Messages sent outside the portal are not HIPAA secure and are not part of the clinical record.
Do not send clinical details, protected health information, or sensitive content by text or email.

20. Payment Reference Requirement
Patients must include their initials, provider name, and appointment date in the payment note for all payments sent by Cash App, Zelle, PayPal, Venmo, or any other method.
​
21. Time Zone and Cancellation Method
All deadlines, fees, and time-based rules use Eastern Time.
Clients must contact their provider to cancel, using the communication method established during intake. The provider's cancellation method controls.

22. Subscription Terms
Prepaid subscription plans are governed by the rules listed on the subscription page. See the subscription page for rules of use. Services included, services excluded, rollover rules, and any unused month rules are stated on that page.

23. Refund and Deposit Exception
Refunds and chargebacks are not permitted for any services provided by Empowered Harmony Counseling.
Deposits are refundable only when the patient cancels with at least 72 hours' notice. This deposit refund is the only exception to the no-refund rule for patient cancellations.

No refunds or chargebacks are permitted for cancellation fees, late fees, no-show fees, or any other non-refundable service.
Provider Cancel Disclosure
If a provider cancels on the same day due to illness or an emergency, the client may request either a credit toward a future appointment or a refund for the specific session the provider canceled. This provider's cancellation option does not apply to patient cancellations.

24. Eligibility for Services
Services are available to individuals age 7 and older.
Patients must be physically located in the United States.

Patients must be physically located in a state where the provider is licensed at the time of the session. Scheduling and payment require compliance with this location rule.

Eligibility is also subject to state laws, licensing board rules, payer rules, and clinical appropriateness. Some services, age groups, diagnoses, or levels of care may be limited or unavailable in certain states. Providers may deny, pause, or refer out when required by Law, licensure rules, payer rules, or clinical standards.

25. Records and Documentation Requests
All documentation requests must be submitted to support@empoweredharmony.com.
Documentation requests involve fees, possible mailing fees, and turnaround time. Pricing and timelines vary and are disclosed before work begins.

26. Document Hierarchy
If terms conflict, the controlling order is: signed intake and consent documents, executed service agreements, provider-specific policies given to the client, then this master policy, then general website content.

27. Privacy Policy
Empowered Harmony Counseling is committed to safeguarding the privacy of all visitors, clients, and users. Information such as names, contact details, insurance information, and health data is collected only through secure, HIPAA-compliant platforms and used solely for treatment, billing, and operational purposes. All personal data is encrypted, protected, and never sold or shared without explicit written consent unless legally required.

28. Notice of Privacy Practices, HIPAA
In accordance with federal Law, this notice outlines how your protected health information, PHI, may be used or disclosed. Permitted uses include treatment coordination, billing, internal operations, and legally mandated disclosures, such as reporting abuse, responding to subpoenas, and other legal requests. You have the right to access, correct, restrict, or request a copy of your PHI at any time.

29. Terms of Service and Conditions of Use
By accessing this website or engaging in services, you agree to adhere to all stated terms. This includes respecting intellectual property, using this site lawfully, and acknowledging the limitations of online communication. Unauthorized reproduction or misuse of content may result in the removal of access and legal recourse.

30. Client Rights and Responsibilities

The right to discontinue services at any time.
Your Responsibilities Include
Arriving on time for appointments or canceling within the required time frame.
Being honest and open with your provider for effective care.
Paying for services or copayments on the date of service.
Treating providers and staff with courtesy and respect.

32. Accessibility Statement and Language Access Commitment

Interpreter services, including American Sign Language, are available at no cost to patients.
Please notify our office at least 48 hours before your appointment if you require interpreter assistance.
Interpreter fees will never exceed the patient's self-pay rate or insurance reimbursement amount.

Providers may choose whether to absorb the cost of interpreter services, but are not required to accept financial hardship or work without compensation.

If providing accommodations would cause significant financial hardship or undue administrative burden, we will work with the client to identify alternative solutions. All decisions are documented in good faith, centered on dignity, rights, and access to care.

33. Telehealth Policy and Consent
EHC provides secure, HIPAA-compliant telehealth services. By initiating virtual care, you consent to services delivered via video or phone.

Client Responsibilities
Ensure a private and safe environment.
Maintain a reliable internet connection.
Telehealth may not be suitable for all concerns.
​
Limitations
Telehealth is not appropriate for psychiatric emergencies. Call 911 or 988 or go to the nearest emergency room in an emergency.
Providers are licensed in specific states. Patients must be physically located in a state where the provider holds an active license during the session.
If a session is interrupted by technical issues, the provider will attempt to reconnect. If unsuccessful, the session may continue by phone or be rescheduled.

34. Informed Consent for Treatment
Clients engage in services voluntarily and may include therapy, psychiatric support, coaching, or holistic care. Clients receive clear information about the scope, risks, benefits, limitations, and the nature of services. Consent is obtained before the start of care and can be withdrawn at any time without penalty.

35. Payment, Cancellation, and Rescheduling Policy
24 Hour Standard Psychotherapy Policy
A $100 late cancellation or no-show fee applies when a patient provides less than 24 hours' notice for standard psychotherapy services. One courtesy cancellation per calendar year may be allowed for emergencies, applicable only to 50-minute psychotherapy appointments. Providers can waive one late fee per year due to an emergency.

48 Hour Weekend Policy for Monday Appointments
A 48-hour cancellation policy applies to all Monday appointments. Patients must cancel by Saturday to avoid the cancellation fee. Patients must cancel by contacting their provider directly through the communication method established during intake or during sessions.
​
72 Hour Specialized Services Policy
Patients must provide at least 72 hours' notice to reschedule any sliding scale service, prepaid subscription plan, concierge service, or other specialized service tier. When required notice is not given, all prior payments for that appointment are forfeited. All specialized services are billed at the full session fee when proper notice is not provided.

Missed appointments or late rescheduling within the 72-hour window for specialized service tiers results in a charge for the full session rate.
​
Payment Policy
All copays and self-pay fees must be paid in full at least 24 hours before the scheduled appointment. Advance payment allows providers to begin the session on time and remain focused on care. Services cannot be provided without full payment. A missed payment is treated as a no-show. The no-show fee applies.
​
If a provider must cancel on the same day due to illness or an emergency, the client may request either a credit applied to a future appointment or a refund for the specific session canceled by the provider.
​
Clients are encouraged to keep receipts for personal records.
​
Payment Responsibility for Out-of-Network Services
Clients are responsible for all out-of-network service fees. When a therapist or psychiatrist is out of network, insurance may pay 70% to 80% of the amount they allow. This amount is often lower than the provider's full fee. You are responsible for the remaining balance.

If your insurance plan does not cover a mental health service, you are responsible for the full cost of that service. This includes services that your plan excludes or does not reimburse.
​
Please get in touch with your insurance company to confirm coverage before scheduling. Empowered Harmony Counseling provides a billing statement upon request so you can submit claims to your insurance.
​
Refund and Chargeback Policy
Refunds and chargebacks are not permitted for any services provided by Empowered Harmony Counseling. This applies to psychotherapy, wellness services, coaching, programs, psychiatric care, and all other EHC services. Patients should contact us first so we can review the account and resolve the concern quickly. This protects continuity of care and prevents service interruption.

No Refunds or Chargebacks
No refunds or chargebacks are allowed for any specialized service, late fee, cancellation fee, or no-show fee.
If a chargeback is filed without contacting us first, the matter is handled directly with the institution. EHC may submit documentation, records, and evidence to resolve the dispute.
​
If a chargeback contains inaccurate information, disputes services already delivered, or misuses the dispute process, the matter may proceed through the courts if needed.
​
Patients should keep receipts and contact us before starting a dispute.
​
36. Appointment Reservations and Deposits
A non-refundable deposit of 25 percent may be required to confirm sessions booked more than 1 month in advance. This applies to private-pay therapy, coaching, wellness services, group sessions, or psychiatric consultations. Deposits apply toward the session balance.

You can make deposits using a credit or debit card, a secure text-to-pay link, PayPal, or Cash App.
Some services, including retreats, corporate programs, or concierge care, may require different deposit structures or full prepayment.
​
37. Cancellations, Late Arrivals, and Missed Appointments
Clients who arrive more than 10 minutes late may be marked as a no-show.
Two or more late cancellations or missed sessions may require a 48-hour prepayment, same-day appointments, or discharge from care.
​
38. Deposit Policy
Deposits are refundable only when the patient cancels with at least 72 hours' notice. When proper notice is given, the deposit is returned in full. This is the only circumstance in which a refund is permitted.
When less than 72 hours' notice is given, a $100 cancellation fee applies, with an additional $150 for psychiatry up to. If a deposit was paid, the fee is deducted from the deposit. If the deposit does not cover the full amount, or if no deposit was collected, the cost is billed as a separate charge.

Deposits are nonrefundable if the patient provides less than 72 hours' notice. No refunds or chargebacks are permitted for cancellation fees, late fees, no-show fees, or any other non-refundable service.
This policy is consistent with the EHC refund and chargeback rules.
​
39. Insurance Claims and Payment for Services
EHC accepts most major insurance plans and submits claims as a courtesy.
Insurance estimates are not guarantees of coverage.
​
If insurance denies a claim, the client is responsible for the full balance.
If insurance pays the client directly, the client must remit that payment to EHC.
Any remaining balance not covered by insurance is billed to the client.
​
EHC verifies benefits in good faith. The insurer makes the final determination of payment.
​
40. Balances and Returned Payments
Accounts that are 60 days past due may be sent to collections.
Returned payments and chargebacks carry a 75 service charge.

41. Payment Options
EHC accepts credit cards, Cash App, Venmo, Zelle, PayPal, FSA cards, HSA cards, and approved third-party payment credit cards, such as Medical Credit, Cherry, and Lending Club. Flexible payment plans may be available for select services.

42. Technology, Communication, and Appointment Confirmation
Appointments must be confirmed by text, email, or phone. Failure to confirm may result in automatic cancellation.
After one missed appointment, scheduling may be restricted to same-day bookings with an additional fee.
After two missed appointments, EHC may discharge the client from care.

For privacy and security
Providers may communicate through EHC Gmail addresses in the format name.EHC@gmail.com or name.number.EHC@gmail.com. Confirm the exact email with your provider before sending information.
Administrative staff communicate only through official empoweredharmony.com addresses. If you receive a suspicious email, contact our office before replying or sharing information.

By receiving services, clients acknowledge and agree to all financial policies and terms listed above.

43. Independent Contractor Disclaimer
All providers affiliated with Empowered Harmony Counseling are independent contractors. They are not employees of EHC. Each contractor is individually responsible for clinical practices, documentation, and professional conduct.
EHC is not legally liable for misconduct, negligence, or malpractice committed by an independent contractor.
Office Space for In-Person and Telehealth Services
EHC does not provide office space for any services, including in-person sessions, teletherapy, or telehealth. Providers must establish and maintain their own private and compliant environment that meets confidentiality, licensing, and ethical standards. We may share resources to help providers connect with others to share space.

EHC shall not be held liable for misconduct, negligence, malpractice, or professional errors committed by an independent contractor.

44. Social Media and Digital Communication Policy
EHC providers do not conduct therapy through social media or unencrypted platforms.
Providers do not accept friend or follow requests from clients.
​
All clinical communication must occur through secure, approved systems such as the client portal.
EHC public pages may share educational content. This does not constitute therapeutic advice or create a clinical relationship.

45. Child and Vulnerable Adult Protection Policy
EHC complies with federal and state laws on mandated reporting. We report suspicion of abuse, neglect, or exploitation of children, elders, or vulnerable adults.

Providers must complete screenings before offering services through EHC, based on state law.
FBI fingerprint-based background checks.
National sex offender registry verification.
Child Protective Services central registry clearance.
​
Providers must upload and certify documents through EHC's credentialing system. EHC verifies documentation is present, but is not the issuing authority, and cannot guarantee completeness of external agency results.

EHC enforces strict compliance but is not legally liable for the personal or professional misconduct of independent contractors.
CYMHS Services
EHC provides CYMHS services in compliance with federal and state laws. Services do not guarantee specific outcomes and are not a substitute for emergency psychiatric care, urgent care, or crisis services. Policies may be updated as standards evolve.

46. Good Faith Estimate Notice, No Surprises Act
Uninsured, out-of-network, or self-pay clients have the right to a Good Faith Estimate of expected costs.
The estimate is provided in writing before the first session or upon request.

The estimate includes anticipated charges based on frequency, type, and provider rates.
The estimate is not binding and may change depending on clinical needs.
​
If the final bill exceeds the estimate by $400 or more, you may dispute the charge by contacting EHC billing or using the HHS patient provider dispute resolution process within 120 days.

47. Contact and Crisis Disclaimer
This website, email, and portal are not monitored 24 hours a day. EHC is not a crisis center.
If you are experiencing a medical or mental health emergency, call 911, dial 988, or visit the nearest emergency room.

Crisis Escalation Policy
If a client is in immediate danger to themselves or others, EHC may contact emergency services or a designated emergency contact. This includes suicidal or homicidal intent or severe impairment. Providers follow clinical protocols to ensure safety. Services may be temporarily paused until the crisis is resolved.

48. Liability Acknowledgment and Waiver
By receiving services, clients acknowledge that providers offering concierge, in-home, or virtual services through EHC are independent contractors.
​
EHC verifies licensure and credentials but does not control clinical judgment.
EHC is not liable for harm, damages, illness, accidents, property damage, or death resulting from contractor services.
Clients understand and agree that EHC does not supervise or control contractor methods or decisions.
Concerns, grievances, or disputes should be addressed directly with the provider.

Services are voluntary, and EHC may discontinue service if safety or ethical concerns arise.
​
EHC shall not be held liable for harm, injury, damages, illness, accidents, property loss, or death resulting from the actions, omissions, or services of independent contractors or third-party affiliates.

49. Zero Tolerance Harassment Policy
EHC enforces a strict zero-tolerance policy for harassment. This applies to all interactions involving clients, providers, contractors, staff, and affiliates.
​
Harassment includes verbal abuse, threats, intimidation, disrespectful or offensive language, unwanted comments or behavior, repeated boundary violations, discrimination based on protected classes, and unwelcome romantic or sexual advances.
​
EHC reserves the right to discontinue services immediately, terminate contracts, and involve legal authorities if necessary.
Reports of harassment should be sent to support@empoweredharmony.com. All reports are reviewed promptly, discreetly, and with care.

50. No Soliciting
EHC does not accept solicitations. Contact forms and email are for clients and contract providers only. Vendor and sales inquiries are not reviewed.

51. Payment Disclaimer and Financial Responsibility Notice
Accepted Payment Methods
EHC accepts PayPal, Cash App, Zelle, and EHR system payments.

Payment Processing Fees, Third Party Charges, and Taxes
